Scratch’s Subscription Program – Electronic Signatures, Records, Disclosures & Communications Consent Agreement (“E-Sign Consent or E-Consent”)

In connection with the application you submitted for the purchase of a subscription plan through Scratch Financial, Inc.’s Subscription Program (“Scratch” or “we” or “us”) found at scratchpay.com (“Site”), we are required by law to provide you with certain disclosures in writing. Without your consent, Scratch is not permitted to provide these disclosures to you online.

1. ELECTRONIC DISCLOSURES

“Disclosures” include, but are not limited to:

all documentation, agreements, amendments and policies required to use the Scratch’s Subscription Program services (e.g., this Subscription Program E-Sign Consent, Subscription Program Privacy Policy, and Subscription Program Agreement);
documentation relevant to an account or service (e.g., payment authorizations, transaction receipts and confirmations);
periodic communications for an account or service, including payment reminders, account statements, billing statements, and account histories;
any notice or disclosure regarding fees, charges, or assessments of any kind such as late fees and returned payment fees;
marketing materials; and
all legal, regulatory or any other disclosures regarding your legal rights and obligations relating to the Scratchpay account and services.

By providing your consent as set forth below (“Consent”), you agree to the following:

Scratch may provide any or all Disclosures either electronically on the Site, through a hyperlink provided on the Site, and, at its sole discretion electronically to the email address or mobile number that you provided to us.
Scratch may, but is not required to, notify you via email or text message when Disclosures are available and how to view them, either via a hyperlink or, email, or other electronic described herein. The Disclosures will be provided to you in a format that can either be retained, printed, or downloaded for your records.
Your electronic signature on agreements and documents has the same effect as if you signed them in ink.
Your Consent means that Disclosures that Scratch provides you electronically shall have the same meaning and effect as if provided in paper form, regardless of whether you actually view those Disclosures.
Your Consent applies to any transaction undertaken through Scratch’s website (www.scratchpay.com) in the past, to all future disclosures and communications, to all future transactions in which you use Scratch, at anytime, to any transaction with us, and to other Disclosures that we provide to you by email.
You consent we will process your information and interact with you electronically.
You consent that we may send emails to you for the purpose of advising you of changes or additions to the Site, about any of our products or services, or for such other purposes as we deem appropriate and as permissible by law.

2. MINIMUM REQUIREMENTS

You understand that, in order to view and/or retain copies of the Disclosures, you will need the following hardware and software:

You will need to use a PC or MAC compatible computer or other device capable of accessing the Internet
A valid email address, and, if you use a spam filter that blocks or re-routes emails from senders not listed in your address book, you must permit messages from the scratchpay.com domain in your spam filter;
You will need an internet browser software program that supports TLS 1.2 or higher.
Mobile connectivity with the ability to download and run software from as described in this Section 2.
A working mobile telephone number that can receive text messages.
Sufficient storage space to save Disclosures or the capability to print the Disclosures from the device on which you view them.
To read some documents, you may need a PDF file reader like Adobe® Acrobat Reader Xpdf® or Foxit® and hardware capable of running this software.
You will need a printer or a long-term storage device, such as your computer's disk drive, to retain a copy of the Disclosures for future reference.

We will notify you if our hardware or software requirements change and whether that change creates a material risk that you would not be able to access or retain electronic Disclosures. Continuing the use of Scratch’s Services after receiving notice of the change is the reaffirmation of your E-Consent.

3. WITHDRAWING CONSENT

You are free to withdraw this E-Consent at any time and at no charge. If at any time you wish to withdraw this E-Consent, you can send us your written request by mail to Scratch Financial Inc., Attn: Servicing Team - Subscription Program Support, 225 S. Lake Avenue, Suite 250, Pasadena, CA 91101, with the details of such request. Any withdrawal of your E-Consent will be effective after a reasonable period of time for processing your request. If you decide to withdraw this E-Consent, the legal effectiveness, validity, and enforceability of prior electronic Disclosures will not be affected. You acknowledge and agree that any monthly payments owed pursuant to the Subscription Program Agreement will remain in effect even if you withdraw your Consent.

4. RIGHT TO REQUEST AND RECEIVE PAPER COPIES

You agree that Scratch may modify or change the methods of disclosure described herein, and may send you Disclosures in paper form at its option. You may request any Disclosures in paper copy by logging in and printing a paper copy (free of charge). You may also mail us your written request to Scratch Financial Inc., Attn: Servicing Team - Subscription Program Support, 225 S. Lake Avenue, Suite 250, Pasadena, CA 91101. We will provide paper copies at no charge. We will retain all Disclosures as applicable law requires.

5. UPDATING YOUR INFORMATION

You agree that it is your responsibility to notify Scratch of any changes to your primary electronic (email) address, mailing address, mobile phone number, or any other contact information so that Scratch can communicate with you electronically. You agree that Scratch is not responsible for any delay or failure in your receipt of any Disclosure, text message or email notice that is not caused by Scratch’s failure to send such Disclosure or notice to the phone number or email address you have provided to Scratch. Scratch will not assume liability for non-receipt of notification of availability of electronic documents in the event your mobile number, email address or contact information on file is invalid; your email or Internet service provider filters the notification as “spam” or “junk mail”; there is a malfunction in your computer, mobile device browser, Internet service, mobile connectivity and/or software; or for any other reason beyond Scratch’s control.

It is your responsibility to provide us with true, accurate, and complete mobile number, e-mail address, contact information, and other information related to Scratch’s Subscription Program services, and to maintain and update promptly any changes in information. You may update such information by sending an email to [email protected]or by writing to us at Scratch Financial Inc., 225 S. 6. YOUR CONSENT TO ELECTRONIC DISCLOSURES (“Consent”)

BY CLICKING "AGREE" OR OTHER LINKS, YOU CONSENT TO THE FOLLOWING: (1) YOU ACKNOWLEDGE YOU HAVE READ THIS INFORMATION ABOUT ELECTRONIC SIGNATURES, RECORDS, DISCLOSURES, AND DOING BUSINESS ELECTRONICALLY. (2) YOU CONSENT TO USING ELECTRONIC SIGNATURES, HAVING ALL DISCLOSURES PROVIDED OR MADE AVAILABLE TO YOU IN ELECTRONIC FORM AND TO DOING BUSINESS WITH US ELECTRONICALLY. (3) YOU ACKNOWLEDGE THAT YOU MAY REQUEST A PAPER COPY OF THE ELECTRONIC RECORDS AND DISCLOSURES, WHICH WE WILL PROVIDE TO YOU AT NO CHARGE. IF YOU REFRAIN FROM PROCEEDING, THEN YOU NEITHER WISH TO USE ELECTRONIC SIGNATURES NOR CONDUCT THIS TRANSACTION ELECTRONICALLY.
